Three families from the Roma community had built their homes before 1991 near the road segment Commune of Paris – Rruga e Kavaja. In 2016, the works for the construction of the Great Ring of Tirana would start on this road segment. These families, learning about the construction of the road segment that was expected to start and would destroy their houses, applied to the Municipality of Tirana in accordance with the criteria of VKM No. 608 dated 05.09.2012, to acquire ownership and consequently benefit from the expropriation procedure. The Municipality of Tirana did not notify the families that had applied, but I notified the ARSH that the applicants do not qualify and do not meet the criteria to be recognized as owners and based on the letter from the Municipality of Tirana, the Albanian Road Authority requested the National Inspectorate of Territory Protection (IKMT) to intervene to free the construction site from the objects. The residential houses of three families were destroyed by the action of the IKMT on 18-19.02.2016 and the families remained homeless, being economically damaged, because they lost the investment of their whole life and suffering a great emotional and psychological burden. These families contacted the lawyers of the Law Clinics (now the Centre for Legal Empowerment), who showed their willingness to represent them before the Court, and the legal proceedings lasted from 2016 to 2022.
In the first case, the Administrative Court of First Instance Tirana with the decision dated 13.12.2016 accepted the lawsuit and recognized the plaintiffs P.G. and his family the right to compensation from the Municipality of Tirana and IKMT in the amount of 5,822,000 Lek
In the second case, the court with the decision dated 22.09.2020 accepted the lawsuit and recognized G.J. and his family the right to compensation from the Municipality of Tirana and IKMT in the amount of 3,785,000 Lek.
In the third case, the court through the decision that was announced on Wednesday, June 14, 2022, accepted the lawsuit and recognized A.M. along with his family, the right to compensation from the Albanian Road Authority in the amount of 5,596,555 Lek.
