Center for Legal Empowerment: Mediation is the missing mechanism for resolving disputes at work

The resolution of disputes in labor relations in accordance with the laws in force and contractual conditions continues to be a problematic issue or sector with many unknowns, not only for employees but also for employers.
Center for Legal Empowerment is implementing the project “Implementation of mediation in labor relations in the field of fashion and call center”, which is supported by the Open Society Foundation for Albania in cooperation with the Gjirokastër Chamber of Commerce and Industry.
To increase the level of information of all actors involved in the process of resolving contractual disputes through mediation, the Center for Legal Empowerment is developing a campaign with field activities sitting together with businesses, employers, interest groups and chambers of commerce trade.
In this framework, the meeting took place in the city of Gjirokastra, where the Executive Director of CLE Franc Terhiati presented to the attendees the concrete objectives of the initiative that the center is implementing and the importance of recognizing the process of mediation by the actors involved.
“Mediation of disputes in labor relations is a concept that brings advantages in cases where it is applied, guaranteeing to all parties involved the respect of their contractual rights and obligations,” said the legal expert Prof. Dr. Sokol Mënjesi, who is the author of an informative summary “Resolution of disputes in labor relations through mediation” which he realized with the support of CLE.
Meanwhile, Mr. Maksim Hoxha, Chairman of the Gjirokastra Chamber of Commerce and Industry, presented the business point of view regarding the application of the mediation procedure, while Mr. Pirro Boboli – Lawyer/Mediator, presented to the audience the way of developing the mediation procedure and the effects of mediation agreement.
The meeting, which was moderated by Av. MSc. Arbesa Kurti, Legal Expert, who expressed her readiness to provide the necessary information and training for the employing enterprises operating in the district of Gjirokastra to make them aware of the rights and obligations in labor relations, as well as the advantages of the implementation of mediation procedure.
Also, the mediators and representatives of the institutions that were present at the meeting exchanged information about the initiatives that are being undertaken in the context of the implementation of alternative methods for resolving disputes, such as mediation.
